JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 504, 307, 379/34 of the Indian Penal Code.

It would appear from perusal of the first information report that alleged occurrence took place on account of dispute of a passage and in that dispute, petitioner and his associates assaulted the informant. The specific allegation against the petitioner is that he gave farsa blow causing injury on the head of the informant but impugned order shows that simple injury was found on the person of the informant. The petitioner is in jail custody since 02.02.2016.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.12915 of 2016 (2) dt.31-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Dhaka P.S.
