JUSTICE ARUN KUMAR ORAL ORDER 03-08-2018 Heard learned counsel for the petitioner, the informant and the learned Additional Public Prosecutor. This is a petition for grant of regular bail in connection with Thawe P.S. Case No. 19 of 2018 for offences under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.
Accusation, in brief, is that when the informant went to complain regarding his nephew's act of assault then petitioner gave a sword blow over informant's head.
Learned counsel for the petitioner submits that informant's side was the aggression and there was case and counter case between both sides and the petitioner has been in custody since 25.02.2018, no repetition of blow was given by
Patna High Court Cr.Misc. No.29332 of 2018( 5) dt.03-08-2018 2/2 the petitioner and the injury is only muscle deep. However, learned counsel for the informant opposed the prayer for bail as informant's injuries on vital part of head are grievous.
Having considered the aforesaid facts and circumstances, and the nature of injuries that is on the vital part, the Court is presently not persuaded to grant bail to the petitioner.
However the petitioner may renew the prayer for bail after six months.
