JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.

The prosecution case is that petitioner assaulted the informant and informant' wife with spade, whereas co-accused Asgari Khatoon assaulted the daughter of the informant with lathi.

It is submitted by learned counsel for the petitioner that injuries of the informant informant's wife have been found to be marginal size, simple in nature, caused by hard and blunt substance, whereas accusation is of causing injuries with spade. The accusation has been levelled in the background of serious land dispute between the parties from before.

Patna High Court Cr.Misc. No.41117 of 2015 (2) dt.07-10-2015 2/2 petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa (Balia Belon) P.S. Case No. 70 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
