====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 05-09-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 30(a), 32, 41 and 56(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery of liquor is alleged from the bush nearby house of the petitioner no. 1 Manoj Mandal and from the bag of petitioner no. 2 Ashish Kewat. Both have got identical criminal antecedent.

Considering the facts aforesaid, let the petitioners, above named, be released on bail, if the trial of the case is not concluded within a period of six months from the date of framing of the charges against the petitioners, on furnishing

Patna High Court CR. MISC. No.55332 of 2019(2) dt.05-09-2019 2/2 bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No. 125C-2 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
