JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-08-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the University. Mr. Dhruba Mukhrjee submits that the writ petition may be disposed of with liberty to the petitioner to approach the Vice-Chancellor of the University for reconsideration of this case for payment of salary for the aforesaid period considering the interest of the petitioner as well as the interest of the public exchequer.
Considering the totality of the facts situation including the fact that this court has issued direction in 2010, petitioner would be entitled payment of salary from the date of direction issued by this Court from 7.9.2010 to 2014.
Patna High Court CWJC No.21285 of 2014(2) dt.08-08-2018 2/2 So far as the period prior to from 1.9.2004 to 7.9.2010 is concerned, the University is required to work out the entitlement of the petitioner of monetary benefit at the rate of 50 per cent of the salary admissible to the petitioner from 2004 to 6.9.2010 and ensure payment of the same to the petitioner within a period of four months from the date of receipt/production of a copy of this order.
With the aforesaid, the writ petition stands disposed of.
