Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The prosecution case is that dacoity was committed in the house of the informant, leading to registration of the First Information Report against 20-22 unknown. The name of the petitioner sprang up during investigation on the confession of co-accused. It is submitted by the learned counsel for the petitioner that except the confession, nothing has been collected during investigation. Statement has been made in para-3 of the petition that petitioner has no criminal

Patna High Court Cr.Misc. No.41302 of 2015 (2) dt.08-10-2015 antecedent and there is no recovery from the petitioner. The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Madhuban P.S. Case No. 205 of 2013, pending in the court of learned SubDivisional Judicial Magistrate, Sikrahana, East Champran at Motihari.

With this observation this application is disposed of.
