ANJANA MISHRA ORAL ORDER 14-10-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 11.06.2019 in connection with Shiv Sagar P.S. Case No.213 of 2019 registered for the offence under Sections 30(a) and 41 of the Bihar Excise Act, 2016.

Learned counsel for the petitioners submits that the petitioners are neither the Driver nor the Khalasi of the truck from where alleged recoveries are said to have been made. Learned counsel for the petitioners submits that the alleged recoveries were not from the conscious possession of the petitioner and they were not aware of the transportation of

Considering the facts and circumstances of the case, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Rohtas at Sasaram, in connection with Shiv Sagar P.S. Case No.213 of 2019.
