2. The petitioner is in custody in connection with Tiyar P.S. Case No. 55 of 2025 for the offence punishable under sections 103 and 3(5) of the B.N.S., lodged on 09.06.2025 by the informant, Durgawati Devi.
3. As per the prosecution story, the informant alleged that upon receiving telephonic information about the illness of daughter, they rushed to the hospital but found her dead as she wanted the deceased to be taken to her house, the accused person dropped them from the Ambulance and took away with the body expecting killing, the F.I.R.
4. Learned counsel for the petitioner submits that on a minor tiff, the girl consumed poison, was rushed to the hospital where she breathe her last, in any case, the lady being mother-
Patna High Court CR. MISC. No.55378 of 2025(2) dt.12-08-2025 2/3 in-law was living separately having no role to play and the husband is in custody. The petitioner has remained in custody since 11.06.2025.
5. Learned APP opposes the prayer for bail.
6. Taking into account the submissions of the parties as also the fact that the husband is in custody, no postmortem report is there, F.I.R. lodged, charge-sheet submitted, the lady shall be facing the trial, in that background, this Court is inclined to extend him the privilege of bail.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Tiyar P.S. Case No. 55 of 2025 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) vinayak/- U T
