JUSTICE ARUN KUMAR ORAL ORDER 16-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 17.2.2018, seeks bail in Complaint Case No. 3513 (C) of 2010 registered under Sections 406, 420 and 120B of the IPC.

The allegation in brief is that the petitioner, land owner, entered into agreement for sale and received two lakh rupees in cash and two cheques in total of two and half lakh rupees but those cheques were not encashed, however neither sale deed was executed nor cash taken by the petitioner was returned. Learned Counsel for the petitioner submits that all the frauds were played by one Birja Yadav, two cheques were never encashed by the petitioner and two lakh cash was not received by him so he after knowing this fact filed a complaint case against Birja Yadav and others but not against the present complainant and the petitioner is in custody since 17.2.2018.

Whereas learned Counsel for the complainant opposed the prayer for bail and submits that he has antecedent of similar nature.

Patna High Court Cr.Misc. No.28468 of 2018 (3) dt.16-05-2018 Having considered the aforesaid facts and circumstances as also the nature of dispute, the petitioner, namely, Dhrupat Thakur is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, lst Class, Patna in connection with Complaint Case No. 3513 (C) of 2010.
