JUSTICE MADHURESH PRASAD ORAL ORDER 17-02-2018 Heard counsel for the petitioners and the State. Petitioners are accused in a case registered for offence under sections 302, 120B/34 IPC and 27 Arms Act. Counsel for the petitioners submits that the informant claims himself to the eye witness of the occurrence, but has not named the petitioners in the FIR. The victim had enmity with several other persons and the petitioners have been named in this case merely on suspicion. Petitioners have no antecedent and are in custody since 13.10.2017, though charge sheet has already been submitted in the case.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let both the petitioners, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction

Patna High Court Cr.Misc. No.62947 of 2017 (3) dt.17-02-2018 of the Additional Chief Judicial Magistrate, Saharsa in Bangaon Police Station Case No. 110 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the Petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and (b) The petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
