Petitioner, who is in custody, seeks bail in connection with Bhabua P.S. Case No. 617 of 2017/Tr. No.2309/2017 registered for the offences punishable under Sections 363, 363(A) of the Indian Penal Code.

Informant in his written complaint has stated that on 29.09.2017 in the night at about 12.30 he was sleeping along with his wife then petitioner entered in the hut and took his one year old son from the lap of his wife and fled away with three other unknown accused on motorcycle. The incident is of 29.09.2017 but there is no explanation of lodging F.I.R. on 02.10.2017. During investigation, it has come that there is dispute between the

It has been further submitted that the place is accessible by any person even by wild animal and due to previous enmity and dispute, the petitioner has been implicated in this case. Charge sheet has already been submitted against the petitioner. The petitioner has no criminal antecedent and he is in custody since 07.10.2017.

Considering the aforesaid fact and circumstances of the case let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua, in connection with Bhabua P.S. Case No.617/2017, Tr. No.2309/2017.
