JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-11-2019 The petitioner seeks bail in anticipation of his arrest in connection with Kako P.S. Case No. 38 of 2019, dated 15.02.2019, instituted for the offences under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code. It has been alleged in the F.I.R. that while the informant had gone for a stroll along with the petitioner, the petitioner had stealthily put his mobile in the pocket of the informant and then, taking it as a pretext, assaulted him by means of iron rod.
Learned counsel for the petitioner has submitted that the accusation does not appear to be correct. There is

No.55492 of 2019(3) dt.16-11-2019 2/2 an earlier version of the occurrence which is absolutely different and which case has been lodged by one of the coaccused persons of this case. Apart from this, it has been submitted that the injuries suffered by the informant is stated to be simple in nature. The petitioner is the covillager of the informant. Regard being had to the aforesaid facts as also the clean antecedents of the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Jehanabad, in connection with Kako P.S. Case No. 38 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
