The petitioner seeks bail in a case registered under Sections 147, 148, 149, 387, 307, 120(B) of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that while the informant and her husband were to the Hat to buy vegetables, the accused persons having fire-arms in their hands, made indiscriminate firing, as a result of which, the informant's husband sustained injury.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.55416 of 2019(2) dt.03-09-2019 2/2 petitioner is in custody since 15-02-2019. Charge sheet has already been submitted. General and omnibus allegation has been made against the petitioner. No specific overt act has been attributed against the petitioner. The other co-accuseds with similar allegations have been granted bail by this bench and a coordinate bench of this court vide Annexure-3 series to the present application.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 159 of 2016.
