2. Petitioner seeks regular bail in connection with Kankarbagh P.S. Case No. 643 of 2024, dated 02.09.2024 in a case registered for the offences punishable under Sections 126, 115(2), 109 and 3(5) of the B.N.S. and under Section 27 of the Arms Act.
3. As per prosecution story, petitioner is tenant of the informant and it is alleged that when the informant demanded rent, the petitioner along with other co-accused persons assaulted the informant and also opened fire on him.
4. Learned counsel for the petitioner submits that petitioner is a student and has falsely been implicated in the present case due to ulterior motive. The allegation levelled
Patna High Court CR. MISC. No.58085 of 2025(3) dt.17-10-2025 2/2 against the petitioner in the FIR is false and fabricated and the petitioner has committed no such offence as alleged in the FIR and only to harass the petitioner, informant has lodged this false case. Petitioner is in custody since 28.04.2025 and he claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateXI-cum-C.J.(SD) XI, Patna, in connection with Kankarbagh P. S. Case No. 643 of 2024.
