The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 307, 147, 148, 149 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that on petty issue, the accused persons, variously armed, fired upon the informant due to which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.6.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to be member of unlawful assembly. The allegation of assault is

Patna High Court CR. MISC. No.53354 of 2019(2) dt.26-08-2019 2/2 alleged against the co-accused Deepak Yadav who is alleged to have fired upon the informant. There is no allegation of assault alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Muffasil P.S. Case No. 169 of 2019.
