JUSTICE PRABHAT KUMAR JHA ORAL ORDER 09-10-2015 Heard the learned counsel for the petitioner, the learned counsel for the complainant and the learned Additional Public Prosecutor.

The petitioner apprehends his arrest in a case under Section 467, 420, 120B and 471 of the Indian Penal Code. The complainant alleged that the petitioner and others took her signature on a plain paper on the pretext of providing job to her son on compassionate ground but that paper was fraudulently converted into a sale deed.

The learned counsel for the petitioner submits that the entire allegation is false and concocted. The complainant had agreed to execute a sale deed with regard to a piece of land and she received bank draft of Rs. 4 lacs on 03.03.2009 and the

No.27246 of 2015 (3) dt.09-10-2015 2/2 petitioner handed over a post dated cheque for Rs. 1, 50, 000/- but the complainant did not execute the sale deed and for that the petitioner filed complaint case No. 1521/2009. The complainant also filed complaint case No. 2825 of 2009 in which the petitioner has already been granted anticipatory bail vide order passed in ABP No. 1309 of 2010.

The learned counsel for the complainant, however, vehemently opposed the prayer for anticipatory bail. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S. K. Rai, learned Judicial Magistrate, 1st class, Muzaffarpur in Complaint. Case No. 2988 of 2009, Trial No. 4223/ 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
