The petitioner seeks regular bail in connection with Excise Case No 07 of 2018 (Gopalganj) for the offences punishable under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.. The allegation is regarding recovery of 2916 liters of illicit liquor from a truck which was apprehended by the police and the driver of the said truck fled away while the petitioner who is stated to be the cleaner was arrested.
The learned counsel for the petitioner submits that the petitioner is innocent and he is neither the driver nor the owner of the said truck, hence, the liability of the licit liquor seized by the police cannot be saddled on the petitioner. It is further submitted that the petitioner being a cleaner was not having the knowledge
Patna High Court Cr.Misc. No.27320 of 2018 (3) dt.28-05-2018 2/2 as to what was being transported in the said truck. It is further submitted that petitioner has a clean antecedent and is languishing in custody since 10.01.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge (Excise), Gopalganj, in connection with Excise Case No. 07 of 2018.
