The petitioner seeks bail in a case registered for the offences punishable under sections 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected vide order dated 13.08.2014 passed in Criminal Misc. No. 28862 of 2014. The petitioner is alleged to have fired which caused injury to Pankaj Choubey in his shoulder but the doctor opined the injury to be grievous in nature. The petitioner is in jail for the last one and a half years.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail in connection with

Patna High Court Cr.Misc. No.48318 of 2014 (7) dt.26-08-2015 Taraiya P.S. Case No. 23 of 2014 pending in the court of Sri S. C. Shrivastava, Judicial Magistrate, 1st Class, Chapra. This application for bail is, accordingly, rejected. The trial court is directed to expedite the trial of the petitioner and conclude the same within six months from the date of receipt/production of a copy of this order. If the trial is not concluded within the time aforesaid, the petitioner may renew his prayer for bail firstly in the trial court.
