The petitioner seeks bail in Rajepur P.S. Case No. 54 of 2017 registered for the offence punishable under Sections 457 and 380 of the Indian Penal Code.

Informant has alleged in his complaint that he resides outside to earn his livelihood and on 25.04.2017 some unknown thieves jumped in the courtyard of his house and after breaking the lock of his house stolen away ornaments and clothes after locking the room of his old mother from outside. The name of the petitioner has surfaced on the basis of confession made by Avinash Kumar who has confessed his guilt and also disclosed the name of the petitioner and other co-accused. It has been submitted on behalf of the petitioner that no recovery has been

Patna High Court Cr.Misc. No.371 of 2018(2) dt.17-01-2018 2/2 made from the possession of the petitioner and except confession of Avinash Kumar, nothing incriminating has been found against the petitioner. Petitioner is in custody since 19.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar, East Champaran at Motihari in connection with Rajepur P.S. Case No. 54 of 2017.
