The petitioner seeks bail in connection with Madhubani Town P.S. case No.152 of 2016 (G.R. No.850 of 2016) registered under Sections 406, 420, 409, 467, 468, 471, 120B/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Madhubani.

The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that an amount of Rs.46 lacs was misappropriated by the petitioner in respect of the scheme relating to Swakshta Abhiyan, where the toilets were to be constructed in the rural areas.

Patna High Court Cr.Misc. No.26944 of 2018(6) dt.28-11-2018 2/2 A report was called for regarding the stage of the case. The court below submitted the report indicating that within a period of two months the trial is expected to be concluded. Considering the nature of acquisition and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.

The court below is directed to take all necessary steps to conclude the trial at the earliest.
