JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Bela P.S. Case No. 05 of 2018, G.R. No. 406 of 2018 for the offence under Sections 278, 284, 285, 287, 290, 420, 467, 468, 120(B) / 34 of the Indian Penal Code and Section 11(d) (e) (c) of Prevention of Cruelty to Animal Act, 1960.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 29.1.2018. He further submits that in the instant case the main accused, who was running the business, has been granted anticipatory bail and similarly circumstanced three other coaccused have been granted regular bail. Counsel placed reliance on the order of the Co-ordinate Benches of this court in Cr.
Patna High Court Cr.Misc. No.27820 of 2018(3) dt.06-06-2018 2/2 Misc. No. 26362 of 2018 vide order dated 08.5.2018, whereby Ankit Kapoor was granted anticipatory bail, Cr. Misc. No. 25600 of 2018 vide order dated 04.5.2018, whereby Dr. Parvej @ Dr. Parvej Akhtar has been granted anticipatory bail and Cr. Misc. No. 29789 of 2018 vide order dated 15.5.2018 whereby three similarly circumstanced co-accused have been granted regular bail.
Considering the fact that petitioner has remained in custody for more than four months and similarly circumstanced other co-accused have been granted bail, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II-cum-Sub Judge-XII, Muzaffarpur in connection with Bela P.S.
