JUSTICE MUNGESHWAR SAHOO ORAL ORDER 13-10-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, namely, Ramashankar Kamkar who apprehends his arrest in Brahampur(Krishna Braham)P.S. Case No.106 of 2015 under Sections 406, 420 and 34 of the Indian Penal Code.

According to the prosecution case, the petitioner is the purchaser of the land from the informant. The allegation is that the nephew of the informant with conspiracy sold the ancestral property of the informant to the purchasers.

The learned counsel for the petitioner submitted that there are 13 accused persons including the petitioner and out of them, 12 have already been granted anticipatory bail by this Court.

Patna High Court Cr.Misc. No.42094 of 2015 (2) dt.13-10-2015 According to the learned counsel, dispute raised in the F.I.R. is purely of civil nature.

Considering the above facts and submission of the learned counsel, I direct the petitioner named above to surrender before the court below within six weeks from today and on his so surrendering, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.5,000/-(Rupees five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Brahampur(Krishna Braham)P.S. Case No.106 of 2015.
