JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have opened fire causing firearm injury on right elbow of the injured. Although primary injury report is not available on the record nor in the impugned order but Annexure-4 to the petition shows that one lacerated wound with injury 11⁄2 cms. X 1 cm. X skin deep over right arm and one abrasion of 5 cms. X 5 cms. over right shoulder were found on the person of the injured and for the aforesaid act, petitioner is in jail custody since 02.01.2016. Petitioner does not have any criminal antecedent and the alleged occurrence appears to have taken place on account of petty issue as both the parties are neighbours.

No.12830 of 2016 (2) dt.30-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa in connection with Hilsa P.S.Case No. 570 of 2015.
