Petitioner, already in custody, seeks bail in connection with Dehri (Dalmianagar) P.S. Case No.318 of 2015 registered under Sections 326 and 307/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that while the informant's brother was returning back in the night from the bus stand, an attempt on his life was made by shooting at him. Learned counsel for the petitioner submits that petitioner is not named in the FIR, moreover the informant is also not the eye witness and the only material against the petitioner is the statement of the victim who gave statement that this petitioner was pillion rider and fire was shot by one Jai

Having considered that the specific accusation is against one Jai Prakash Singh, another accused of firing and causing injury to the informant's brother and the petitioner having no criminal antecedent, petitioner Om Prakash @ Om Prakash Yadav @ Bhulan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Dehri, District Rohtas at Sasaram in connection with Dehri (Dalmianagar) P.S.
