JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 01-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. There was an occurrence wherein prosecution parties were brutally assaulted, causing injuries to Chano Yadav, Usha Devi, Indu Devi, Baby Devi, Dinesh Yadav. During course thereof, it has been alleged that both the petitioners along with Kunti Devi assaulted with lathi. From the order impugned, it is evident that Chano Yadav died during course of treatment. Furthermore, it is evident that counter case bearing Laxmipur P.S. Case No. 198 of 2014 is also pending at the end of the accused persons.
In the aforesaid facts and circumstances of the case, considering the nature of allegation attributed against both the
Patna High Court Cr.Misc. No.12429 of 2016 (2) dt.01-04-2016 2/2 petitioners, namely, Binda Devi and Gujri Devi independently are directed to be released on bail in the event of their arrest/surrender within six weeks from the date of production/receipt of the order on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 205 of 2014, subject to the condition as enumerated under Section 438(2) of the Cr.P.C. (Aditya Kumar Trivedi, J) Vats/- U T
