JUSTICE MADHURESH PRASAD ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 414 of the Indian Penal Code and 25(1-B)A/26 of the Arms Act. Counsel for the petitioner submits that neither in the contents of the FIR nor in the statements of the accused recorded in course of investigation his name has come but he has been implicated in this case merely because in the formal FIR his name figures at Serial No. 3 of the accused persons. On the basis of such baseless situation he is in custody since 16.09.2017. He is a man of clean antecedent.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the

Case No. 229 of 2017 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
