Petitioner is apprehending his arrest in connection with Bettiah Mufassil P.S. Case No.295 of 2022, registered for the offence u/s 341, 323, 324, 307, 354(B), 379, 504 read with section 34 of the IPC.
Allegedly, the F.I.R. named accused persons including the petitioner is said to have assaulted the informant's side by means of various weapons due to a land dispute. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to the admitted land dispute. Patna High Court CR. MISC. No.56528 of 2022(2) dt.03-01-2023 2/2 taken place. Petitioner and informant are the own brothers and there is admitted land dispute between them. Petitioner has one criminal antecedent.
Learned APP for the State opposed the prayer for bail by submitting that there is specific allegation against the petitioner and the injury sustained by the informant was found to be grievous in nature.
Considering that the injury of informant is grievous in nature, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is rejected. This application is accordingly dismissed.
