2. The petitioner who apprehends arrest in connection with Sugauli P.S. Case No. 354 of 2024 lodged on 05.08.2024, for the offences punishable under sections 363, 366A, 34 of the Indian Penal Code.
3. The allegation against the petitioner is of kidnapping the minor daughter of the informant with intent to marry her.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner has a clean antecedent. It is further submitted that

No.55936 of 2025(2) dt.27-08-2025 2/2 though the alleged occurrence took place on 14.06.2024, the F.I.R. was lodged on 05.08.2024, and there is no satisfactory explanation for such inordinate delay. The allegation is general and vague. Learned counsel further contends that upon recovery, the victim had her statement recorded under Section 183 of the BNSS, wherein she did not level any allegation against the petitioner.
5. On the other hand, learned APP for the State vehemently opposes the prayer for bail and submits that since the victim is a minor girl, her statement has no legal value.
6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Sugauli P.S. Case No. 354/2024, pending before the learned Judicial Magistrate, 1st Class, East Champaran, Motihari is hereby rejected. (Dr. Anshuman, J) Ashwini/- U T
