It is submitted that the petitioners were summoned by the police and the police under section 41(1) of the Code of Criminal Procedure asked the petitioners to appear in the court below as the police did not find proper to arrest the petitioners.

It is submitted that the petitioners may appear in the court below and their prayer for regular bail be considered and disposed of on the same day.

Considering the submissions of the learned counsel for the petitioners, this application for grant of anticipatory bail in connection with Saharsa S.C./ST Case No.

Patna High Court Cr.Misc. No.49380 of 2014 (2) dt.09-04-2015 85/13 pending in the court of the Chief Judicial Magistrate, Saharsa is permitted to be withdrawn with direction to the court below that if the petitioners surrender and pray for regular bail, their prayer for bail shall be considered on its own merit and disposed of on the same day.
