A detailed counter affidavit has been filed on behalf of the Principal Secretary, Department of Home, Govt. of Bihar, Patna in terms of direction contained in the order dated 28.09.2015. An order dated 21.11.2013 has been brought on record as Annexure-F which indicates in clear term that the petitioner's grievance was already redressed on 22.11.2013 and the licensing authority has already given a direction for revocation of suspension of arms licence of the petitioner which was communicated to him. Still the petitioner has pursued the matter thereafter.

Patna High Court CWJC No.15135 of 2013 (3) dt.09-11-2015 2/2 Learned counsel for the petitioner submits that he did not have any knowledge regarding such development, however, in my view, the moment the petitioner came to know about the order which has been passed in his favour, he was required to communicate to his counsel immediately which he had not done and in such a manner, the time of this Court as well as the State authorities has been wasted.

Accordingly, this writ application stands disposed of, however, in view of the above, I find it a fit case to award exemplary cost upon the petitioner which is assessed at Rs.5000/-. (Dr. Ravi Ranjan, J) V.K. Pandey/- U
