Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 18.5.2017 passed in Cr. Misc. No.23586 of 2017, on merit and with a direction to the learned trial court to conclude the trial within a period of 09 months and liberty to the petitioner to renew his prayer for bail if the trial is not concluded.

Submission of the learned counsel for the petitioner is that there is general and omnibus allegation and one of the coaccused having similar allegation has been granted privilege of anticipatory bail by this Court, vide order dated 25.4.2018 passed in Cr. Misc. No.25277 of 2018 and the petitioner is in custody for 18 months and up-till-now the charge has not been framed in this

Patna High Court Cr.Misc. No.20006 of 2018 (3) dt.02-05-2018 2/2 case.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that another co-accused has been granted privilege of anticipatory bail, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Tribhuwan Nath, Additional District and Sessions Judge-Vthcum-Special Judge (Excise) Munger in connection with S.Tr. No.244 of 2017 arising out of Kasim Bazar P.S.Case no.153 of 2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled. With the aforesaid observation, this application is allowed.
