The petitioner apprehends his arrest in Lalganj P.S. Case No. 284 of 2021 registered for the offence punishable under Sections 414/34 of the I.P.C. and Section 30(a)/36/41(d) of the Bihar Prohibition and Excise Act.

Altogether 5727.24 litres of illicit foreign liquor has been recovered from two vehicles and petitioner is alleged to be member of syndicate, who brought the aforesaid consignment. Petitioner has got two criminal antecedent of similar nature. Considering the recovery of huge quantity of illicit liquor, criminal antecedent of similar nature and bar of Section 76 (2) of Bihar Prohibition and Excise Act, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected.
