The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 120B of the Indian Penal Code.

No.54635 of 2015 (2) dt.02-12-2015 2/3 The prosecution case is that the informant entered into an agreement with co-accused Vijay Kumar and jointly opened coaching institute and school namely, Front Line Coaching Institute and Front Line School in 1996 and 2001 respectively and opened a joint account in Punjab National Bank, Nawada Branch and a house was taken on rent for five years for running the school but subsequently Vijay Kumar stopped depositing the income of the institutions in the joint account and got the rent agreement renewed with his signature only. He also purchased the vehicles in the name of his family members and misappropriated the amount.
It is submitted by learned counsel for the petitioners that the thrust of accusation is against Vijay Kumar and petitioners have been roped in the present case since they happen to be family members and relatives of co-accused Vijay Kumar.
It is submitted by learned counsel for the informant that the income of the joint venture has been invested in purchase of the vehicles in the family members of co-accused Vijay Kumar, hence, they also connived with co-accused Vijay Kumar in misappropriating the amount.
A statement has been made in paragraph 3
Patna High Court Cr.Misc. No.54635 of 2015 (2) dt.02-12-2015 3/3 of the petition that the petitioners have no criminal antecedent. Considering the thrust of accusation against co-accused Vijay Kumar, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 293 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
