Petitioner, already in custody, seeks bail in connection with Gopalpur PS Case No.138 of 2017, registered under Sections 307/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

It is submitted that the specific allegation of shooting at the injured is against Pradeep Rai and not against any other accused. However, the petitioner is not named in the FIR rather being relative of the accused persons has falsely been implicated and there is counter case in which the petitioner has sustained firearm injury in his leg and the petitioner has no criminal antecedent.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.13828 of 2018(3) dt.02-05-2018 2/2 circumstances, petitioner Sekhar Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Gopalpur PS Case No.138 of 2017.
