Now that the petitioner has even cleared his post-graduation, it is too late in the day now to permit the university to knit-pick on what was permissible and what actually been done in declaration of the result of the petitioner for B.A. Part-III.
The petitioner is short of five marks in award of degree for Hons. Subject, however, the university authorities while declaring the result showed him as
Patna High Court CWJC No.18512 of 2013 dt.23-11-2015 2/2 having passed the examination in 2nd division. Enough time has lapsed now to go back on the issue. As an exceptional case, not to be treated as precedent, let the university award five grace marks to the petitioner and declare his final result, so that he can move on his life. Such exercise must be done within a period of eight weeks from the date of production / communication of a copy of this order.
Writ application stands disposed off with observation / direction as above.
