The petitioner, who is in custody, seeks bail in connection with Bakhtiyarpur P.S. Case No. 245 of 2007 registered for the offence punishable under Sections 376, 511, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. It has been alleged by the informant in her FIR that four persons including petitioner tried to commit rape upon her when she had gone to attend call of the nature with her aunty and in the light of torch four persons were identified including the petitioner and on raising alarm petitioner and other co-accused fled away from the place of occurrence.

It has been submitted on behalf of the learned counsel

Patna High Court Cr.Misc. No.58063 of 2017 (5) dt.12-01-2018 2/2 for the petitioner that petitioner is innocent and he has been falsely implicated in this case. It has further been submitted that petitioner is in custody since 01.08.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Barh, in connection with Bakhtiyarpur P.S. Case No. 245 of 2007.
