2. With consent of the parties, the present writ application is being disposed of at this stage.

Learned counsel for the petitioner has prayed for issuance of writ of Mandamus to the respondent authorities, i.e., the Director, Industry Department, Govt. of Bihar, Patna to consider transferring the petitioner who is posted as office Peon at District Industry Centre, Kishanganj to District Industry Centre, Munger by taking into consideration the poor health of the old aged mother of the petitioner as no one is there to look

2/4 after the mother of the petitioner and also taking into account the fact that sister of the petitioner is mentally challenged, resultantly it is only the wife of the petitioner who can look after the old aged mother of the petitioner. Learned counsel for the petitioner submits that in this regard his mother has also filed representation on 02.12.2024 before the Director, Industry Department, Govt. of Bihar, Patna but till date on the said representation of his mother, no decision has been taken. Learned counsel for the petitioner submits that even he is prepared to file representation for considering his case sympathetically taking into account the fact that apart from him and his wife, there is no one else to look after his aged mother.

Learned counsel for the petitioner, therefore, prays that the present writ application may be disposed of directing the Director, Industry Department, Govt. of Bihar, Patna to consider the representation filed by the petitioner's mother sympathetically and to consider transferring the petitioner who is posted as office Peon at District Industry Centre, Kishanganj to District Industry Centre, Munger.

5. To the aforesaid prayer being made by learned counsel for the petitioner, learned counsel for the respondent State has no objection.

Considering the limited nature of prayer being made by learned counsel for the petitioner and there is urgent need for consideration of the representation filed by the petitioner's mother, this writ application is disposed of by directing the Director, Industry Department, Govt. of Bihar, Patna to consider the representation filed by petitioner's mother dated 02.12.2024 sympathetically and on humanitarian ground. It is expected that necessary orders shall be passed by the Director, Industry Department, Govt. of Bihar, Patna within one month from the date of passing of this order.

7. Needless to emphasise that final order which shall be passed by the Director, Industry Department, Govt. of Bihar, Patna should be reasoned and speaking order after giving an opportunity of personal hearing to the petitioner.

The petitioner is also granted liberty to separately file a representation within one week from the date of passing of this order requesting for transfer from District Industry Centre Kishanganj to District Industry Centre, Munger so that his representation as well as his mother's representation both are considered together by the Director, Industry Department, Govt. of Bihar, Patna.

9. Before parting with the order, it is considered

4/4 appropriate to observe that the petitioner's request deserves sympathetic consideration and it is expected that the respondent No.2, i.e., Director, Industry Department, Govt. of Bihar, Patna will consider the request of the petitioner and his mother on humanitarian ground.

10. With the aforesaid observation and direction, the present writ application is disposed of.

11. All pending I.A.s., if any, is deemed to have been disposed of.
