2. The petitioner has preferred this application for grant of regular bail in connection with NDPS G.R. Case No. 16/2025 arising out of Motihari Muffasil P.S. Case No. 32 of 2025 dated 19.01.2025 registered for the offences punishable under Sections 20(b), 22(b) and 29 of the Narcotic Drugs and Psychotropic Substance Act.

3. As per the prosecution case, total 5.400 Kg. of Ganja was recovered from the pitthu bag of the co-accused, Sunil Kumar and 8.550 Kg of Ganja was recovered from the house of the co-accused, Sanju Devi and Rs. 24,500/-

Patna High Court CR. MISC. No.56613 of 2025(2) dt.13-10-2025 2/3 was recovered from the possession of the co-accused, Sanju Devi.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The seized contraband is less than the commercial quantity. The petitioner has no concern with the alleged recovery. The petitioner has been made accused only because he is the husband of the co-accused Sanju Devi. The co-accused person has already been granted regular bail by this court vide order dated 23.04.2025 passed in Cr. Misc. No. 18726/2025. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 27.05.2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran,
