JUSTICE BIRENDRA KUMAR ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Motihari Town P.S. Case No.676 of 2017, a case under Sections 147/148/149/341/323/353/427/120B/435/332/333/393 of the Indian Penal Code and Section 3/4 of Damage of Public Property Act.

According to F.I.R., the police got information that the murder of a person has been committed and dead-body is lying by the side of the road. When the police reached, a mob of about 300 people, scuffled with the police, damaged the police vehicle and obstructed in discharge of the official duty. The petitioner was identified as a member of the mob.

No.58448 of 2017 (2) dt.14-12-2017 P2/ Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Motihari Town Police Station Case No. 676 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
