JUSTICE SUDHIR SINGH ORAL ORDER 17-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 406, 420, 465 and 468 of the Indian Penal Code.
Allegation against the petitioners is that they took Rs.2,37,000/- from the informant for selling their land but thereafter no sale deed was executed for the same. Thus, petitioners cheated the informant.
It is submitted on behalf of the petitioners that they have got no criminal antecedent. They have been falsely implicated in the present case. The matter relates to sale and purchase of land amounting to civil dispute.
On behalf of the State and the informant, it is submitted that petitioners are named in the F.I.R. and have committed fraud upon the informant.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of
Patna High Court Cr.Misc. No.51072 of 2015 (3) dt.17-02-2016 2/2 learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Sugauli P.S. Case no. 327 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
