The petitioner seeks bail in a case registered for offence under sections 147, 341, 323, 354B of the IPC and under sections 6/8 of the POCSO Act.

FIR alleges that the petitioner and other five persons, having ulterior motive, tried to pull the informant from the Tempo and when she raised alarm the petitioner was apprehended.

Counsel for the petitioner submits that he was the bona fide passenger of the Tempo and has been implicated in this case merely on suspicion, though there is no specific allegation against him. He has no antecedent prior to the lodging of the instant case and is in custody since 12.6.2017. In the facts of the case, prayer for bail of the petitioners is allowed. Let the petitioner, as mentioned above, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge I cum Special judge

Patna High Court Cr.Misc. No.56811 of 2017 (4) dt.02-01-2018 POCSO, Rohtas at Sasaram in Dihri Town Police Station Case No. 416 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with them. The bailor will also undertake to inform the court if there is any change in the address of the petitioner. (b) The petitioner will be well represented on each date and if he fail to do so on two consecutive dates, his bail will be liable to be cancelled.
