Petitioner, who is in custody, seeks bail in connection with Dulhin Bazar P.S. Case No. 337 of 1984 (S.Tr. No. 743 of 1987/1040 of 2015) registered for the offences punishable under Sections 436, 426 and 34 of the Indian Penal Code.

The petitioner was granted bail in this case, but his bail bond was cancelled on 06.07.1999 because of his non appearance. Thereafter, petitioner was declared absconder. Petitioner was apprehended by the police on 16.01.2018. It has been submitted on behalf of the petitioner that he will not misuse the privilege of bail any further. It is further submitted that the petitioner is an old man aged about 65

Patna High Court Cr.Misc. No.27475 of 2018(7) dt.13-09-2018 2/2 years but the Pairvikar did not do the pairvi of the case properly as a result of which the bail bonds of the petitioner was cancelled. The petitioner is in custody since 16.01.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Danapur in connection with Dulhin Bazar P.S. Case No. 337 of 1984 (S.Tr. No. 743 of 1987/1040 of 2015). Petitioner shall remain present on each and every date and non-appearance on two consecutive dates without any valid reasons, the trial court shall be at liberty to cancel his bail bond.
