JUSTICE ARUN KUMAR ORAL ORDER 20-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Karakat PS Case No. 171 of 2016 registered under Sections 341, 342, 323, 504, 506, 307/34 and 302 of the IPC.

The allegation in brief is that the deceased was invited in the ceremony held in the house of the petitioner, there was shortage of food for which he made comment, thereafter all the accused persons assaulted him and it is alleged that the petitioner gave lathi blow over head of the deceased.

Learned Counsel for the petitioner submits that on trivial issue the quarrel took place, father and mother of the deceased have stated in their statement recorded in para 75 and 76 of the case diary that it was Satyendra who gave blow over the deceased and not the petitioner, only one injury is found on the head of the deceased which was proved fatal, moreover the petitioner has no criminal antecedent and is in custody since 21.11.2017. Having considered the said facts and circumstances, the petitioner, namely, Manoj Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Rohtas at Sasaram in connection with Karakat PS Case No. 171 of 2016.
