The petitioner has renewed his prayer for bail in connection with Buniyadganj P. S. Case No. 171 of 2019, dated 11.09.2019, instituted for the offences under Section 302 and 34 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier twice rejected vide orders dated 01.06.2020

Patna High Court CR. MISC. No.67287 of 2021(3) dt.09-02-2022 2/3 and 24.02.2021.

This Court had called for a report about the stage of the case from the court below.

The report dated 4th of January, 2022 indicates that out of 8 charge-sheeted witnesses, only 2 are left to be examined. It appears that in a short while, the trial shall be concluded.

However, looking at the nature of accusation against the petitioner, namely, slitting the throat of the deceased, I am not inclined to grant bail to the petitioner during the pendency of the trial, notwithstanding the fact that she is a lady and is in custody since 12.09.2019.

The prayer for bail is rejected.

However, the trial court is directed to positively conclude the trial within a period of four months failing which the petitioner shall have the liberty to approach the trial court for grant of bail and in that event, the court below shall be under an obligation to record the reasons for the tardy progress of the trial.

The petition stands disposed off
