2. The petitioner seeks bail in connection with Bardaha P.S. Case No. 25 of 2025 dated 01.04.2025, instituted for the offence punishable under Sections 137(2), 96 of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that on 28.03.2025 at about 11 am, when daughter of the informant was going to the field then petitioner came on a motorcycle and abducted the daughter of informant with an intention to marry her. It is further alleged that when the informant along with his family members went to the house of petitioner then they were abused and assaulted by the family members of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that statement of the victim has been recorded under Section 183 of the B.N.S.S. in which she has not supported the case of prosecution. Learned counsel further submitted that from bare perusal of her statement recorded under Section 183 of B.N.S.S., it is explicit that the victim herself went with the petitioner and has admitted her relationship with him. She clearly stated that they got married willingly and she took step as her parents were not consenting to the marriage with the petitioner and were attempting to marry her elsewhere against her wishes. It is next submitted that victim has been handed over to her parents, however, she has clearly expressed her desire to live with the petitioner in her statement. Lastly, it has been submitted that the petitioner is in custody since 03.04.2025, having clean antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of
