ANJANA MISHRA ORAL ORDER 25-01-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 147/ 148/149/341/342/323/324/307/435/436/427/337/338/380/452 /387 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioners submits that the names of the petitioners have been brought into the present case on account of previous enmity as there was a 144 proceeding initiated by these petitioners against the informant and brother of the informant who had a land attached to the petrol-pump. It is submitted that though many other persons have come in to resist the construction of boundary-wall over which the 144 proceeding

Patna High Court Cr.Misc. No.52842 of 2015 (2) dt.25-01-2016 P2/2 was still in progress, the petitioners as well as several other persons have been brought in the present case. Considering the nature of allegations made and that the petitioners have one criminal antecedent which relates to the same occurrence for which the Police has registered a separate case bearing Mohammadpur P.S. Case No. 25 of 2015 and that there is no overtact attributed to these petitioners, let the petitioners abovenamed, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Mohammadpur P.S. Case No. 27 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
