2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 795 liters of illicit foreign liquor has been recovered from a truck and the driver, who was apprehended on spot, disclosed the name of petitioner and others, as the persons who brought said consignment of liquor.

4. Learned counsel for the petitioner submits that nothing article has been recovered from the conscious possession of petitioner and has been made accused only on the basis of confession of apprehended co-accused. Petitioner is neither owner nor driver of the truck in question and has got no concern with the seized liquor.

5. Learned A.P.P. for the State opposes the bail petition and submits that petitioner has got four criminal antecedent, out of which, one is of similar nature.

6. However, considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1cum-A.D.J., Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 176 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay U T
