JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Khizarsarai P.S. Case No. 163 of 2015 registered under Sections 498-A of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.

It is contended that there is no truth in the allegation made in the FIR. Petitioner No.1 is the husband whereas petitioner nos. 2 and 3 are father-in-law and mother-in-law respectively aged about 65 years. They have never subjected the informant of the case to cruelty. They have been implicated in the present case

Patna High Court Cr.Misc. No.52908 of 2015 (2) dt.10-11-2015 2/2 because of matrimonial discord and incompatibility. Learned counsel for the State has opposed the prayer for anticipatory bail.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya in connection with Khizarsarai P.S. Case No. 163 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Pradeep/- U T
