JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 13.11.2017, seeks bail in Khanpur PS Case No. 134 of 2017 registered under Sections 120(B), 201 and 302/34 of the IPC.

The allegation in brief is that earlier a case was lodged by the informant side against the petitioner side and petitioner was pressurizing to withdraw the case and when the informant side made complaint to the police thereafter in the evening the accused persons dragged away the informant's daughter and in the morning her dead body was found. Learned Counsel for the petitioner submits that there was enmity between both sides, no information with regard to taking away the girl was given by the informant on the day of occurrence, the petitioner has falsely been implicated in this case, similarly situated another coaccused Sheela Devi has been admitted to bail by this Court in Cr. Misc. No. 4177 of 2018 and the petitioner has no criminal antecedent except one

Having considered the said facts and circumstances, the petitioner, namely, Sanjay Mahto @ Sajay Kumar Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Samastipur in connection with Khanpur PS Case No. 134 of 2017.
