Since prayer for grant of anticipatory bail on behalf of petitioner no. 2 Batohi Raj @ Ram Suhag Rai has already been withdrawn by order dated 23.09.2015, this application has been heard only on behalf of petitioner nos. 1, and 3, namely, Vimlesh Kumar Rai @ Vimlesh Rai and Panwati Devi. The petitioners apprehend arrest in a case registered for the offences punishable under sections 363 and 365/34 of the Indian Penal Code.
The informant alleged that Vimlesh Kumar Rai, Batohi Raj @ Ram Sohag Rai and Panwati Devi kidnapped his
Patna High Court Cr.Misc. No.43299 of 2015 (3) dt.10-11-2015 minor daughter Renu Kumari. Renu Kumari made her statement under section 164 Cr.P.C. in which she has stated that she voluntarily solemnized her marriage with Vimlesh Kumar six months ago and she is living with her husband Vimlesh Kumar. The victim disclosed her age to be 20 years.
Considering the facts aforesaid, petitioner nos. 1, and 3, namely, Vimlesh Kumar Rai @ Vimlesh Rai and Panwati Devi, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No. 32 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973. (Prabhat Kumar Jha, J) Amin/- U
